I have read the "read first" post, and I understand that this forum is not to be used to aid people in breaking the law. I seek to better understand the legal situation in IL, after the new laws take effect in 2020, in order to avoid breaking the law.
Medical Marijuana card holders can home grow up to 5 plants, and a caregiver can grow up to 12 for each patient. But, recreational users are not allowed to home grow. But, the penalty for growing 5 plants or less is only up to a $200 fine, no incarceration, and is just a civil violation, not even a misdemeanor.
So, I'm curious as to what happens to a recreational user that gets caught growing up to 5 plants at home. Would this hypothetical user merely be subject to a $200 fine? Would the grow equipment and plants be confiscated? Would the plants be weighed if they were in the flowering stage, and any amount exceeding 30g be considered illegal, even if it's not yet matured and dried and in a consumable form, thus deepening the doodoo our hypothetical recreational grower would be in?
I apologize if I've crossed the line asking these questions, but I've scoured the internet and even emailed a couple of lawyers, and haven't gotten a response.
I couldn’t agree more. I know it took Michigan a while to iron out the details and the eventually straightened things out. Hopefully IL will do the same.
